Building a Better Informed Consent, sponsored by the North Carolina Society of Interventional Pain Physicians (www.asipp.org), presented in Charlotte, NC at the Charlotte Motor Speedway.

An informed consent is a great tool for a medical provider to prevent a medical malpractice lawsuit. It is a legal document that informs a patient of the procedure to be provided, the risks of the procedure, and the alternative treatments available. If a patient has an unfavorable outcome, but they were informed of risks of that outcome, it is unlikely the patient will find an attorney willing to take their case. This seminar taught participants how to draft their informed consents to provide their organization and providers with the most protection.

Fraud and Abuse Prevention, sponsored by Buncombe County Chapter of Medical Assistants, presented in Asheville, NC at Mission Hospital.

The federal government has stated in writing that it expects every medical provider to have a fraud and abuse prevention compliance program. This seminar outlined the government’s recommendations on what constitutes an adequate program and advised participants on how to begin drafting and implementing their own customized program.

From Hiring to Firing: How to Manage Legal Risks, sponsored by the Charlotte Regional Medical Group Managers, presented in Charlotte, NC.

Hiring and firing employees entails many legal risks to employers. Attendees learned what types of discrimination are illegal and ways a practice manager might unintentionally discriminate. How to hire and fire while reducing legal exposure was the focus of the presentation. Course materials included a pre-employment inquiries checklist and a discipline and termination checklist.

Introduction to Health Care Law: Legal Concepts to Understand When Working with a Medical Practice or Provider, sponsored by First Citizens Bank.

This seminar was designed to teach a corporation that regularly works with health care providers concepts to share with their clients. For example, a business arrangement that would be great (and profitable) in any other industry might be illegal for health care providers due to Stark regulations. This presentation outlined the major healthcare regulations and how they might affect the clients of this corporation.

Understanding HIPAA 11/14/02

Understanding HIPAA, sponsored by NC Oncology Managers Society (http://www.ncoms.org), presented in Asheville, NC at the Biltmore resort.

Nearly all medical providers have to comply with HIPAA as of April 2003. The government further requires that Covered Entities receive reasonable routine education on how to protect patients’ health information. This seminar reviewed the basic concepts of the privacy rule and emphasized the mandatory components and how to implement them.
