OIG Pursues Penalties For Employing Excluded Individuals
December 8th, 2010
The Office of the Inspector General recently entered into a settlement agreement with American Senior Communities, which provides nursing and rehabilitative services, in which ASC will pay upwards of $375,000 in penalties for employing seven individuals it knew or should have known were excluded from participating in federal health programs.
For more details on the settlement and OIG’s position, see the press release.
The OIG can exclude individuals and entities from participating in Medicare and Medicaid, and from providing care and services to federal program beneficiaries, after conviction for program-related crimes, including fraud. More on exclusion, what constitutes a violation of exclusion, and how to avoid incurring liability, can be found in the OIG’s Special Advisory Bulletin.
