Patient Class Action Lawsuit Filed Against BCBSNC

A class action lawsuit has been filed against Blue Cross Blue Shield of NC (BCBSNC) alleging that the insurer wrongfully allowed policyholders to be charged higher rates for medical services after they exceeded their maximum benefits.

The plaintiff in the lawsuit was apparently charged amounts higher than the Blue Cross contracted amount after he reached the maximum physical and speech therapy benefits. According to the August 5 court ruling, policyholders who have been charged the higher amounts will be notified that they may have a claim.

Next steps include a hearing on a motion for summary judgment to determine whether Blue Cross is permitted to allow in-network providers to charge higher rates after maximum benefits are received.
