New HIV Testing and Reporting Rules (Effective November 1, 2007)

New HIV/AIDS and STD testing and reporting rules that became effective November 1, 2007 include the following revisions:
• Reducing the reporting period for HIV and AIDS from 7 days to 24 hours;
• Addition of Pelvic Inflammatory Disease (PID) to list of reportable diseases that must be reported within 7 days; HIV pre-test counseling is no longer required; Post-test counseling for persons with negative HIV tests is no longer required;
• HIV testing offered as part of a routine lab panel may occur with general consent so long as the patient has the opportunity to opt-out;
• Opt-out testing must be offered to pregnant women at the first prenatal visit and in the third trimester;
• If a pregnant woman’s HIV status is unknown at labor and delivery, rapid HIV testing shall be performed on the mother with or without the woman’s consent;
• If an infant is delivered by a woman whose HIV status is unknown and she was not tested at delivery, the infant will be tested to determine if HIV exposure and/or transmission occurred.
