Blue Cross Settlement Notice Mailing to Physicians on July 27, 2007

After more than three years of lengthy and sometimes difficult negotiations on behalf of physicians, the North Carolina Medical Society is pleased to report that the Notice of Proposed Settlement of the Blue Cross class action settlement and associated claim form will be mailed to physicians commencing July 27.
The notice describes the settlement agreement and method for obtaining the monetary portion of the settlement. In general, physicians will receive payment shares or categories based the physician’s certification regarding their level of gross receipts with Blue Cross for 2004, 2005 and 2006 at: (1) less than $5000 (1 Share), (2) between $5,000 to $50,000 (5 Shares), or (3) $50,000 or greater (10 Shares). Physicians may use a different three-year time period between 1997 and 2006 if he/she files “proof of receipt.”
Retired physicians and legal heirs or representatives of deceased physicians may elect to receive an amount calculated in part based on the number of Retired Physicians filing claims. Physicians may contribute their shares directly to the NCMS Foundation, Inc. In North Carolina, $6.2 million will be distributed to class members. The deadline for submission will be October 19, 2007.
